Terms of Use

By accessing, registering on, or using any website, application, or service operated by Small Fare Services Private Limited ("Small Fare®", "we", "our", or "us"), including but not limited to Events Fare, Payblee, Filmskart, and Viral Wave (collectively, "Services"), you ("User", "you", or "your") agree to be legally bound by these Terms of Use ("Terms").

These Terms constitute a legally binding agreement between you and Small Fare®. If you do not agree to these Terms, you must immediately discontinue use of our Services.

Small Fare® reserves the right to modify these Terms at any time. Continued use of the Services after any changes constitutes acceptance of the revised Terms.

2.1 Age Requirement

You must be at least 18 years of age to use our Services. By using any Small Fare® platform, you represent and warrant that you meet this minimum age requirement and have the legal capacity to enter into binding agreements under applicable law.

For Payblee's financial services specifically, you must additionally be a resident of India and hold a valid bank account in your own name.

2.2 Account Registration

• You must provide accurate, current, and complete information during registration and keep it updated at all times.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately at info@smallfare.com of any unauthorised use of your account or any security breach.
• You may not create multiple accounts, share accounts, or use another person's account without authorisation.
• We reserve the right to refuse registration or cancel accounts at our sole discretion.

2.3 Business Accounts

If you register on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. References to "you" in these Terms include the entity on whose behalf you act.

Small Fare® operates a portfolio of purpose-driven digital platforms. Each platform may have supplementary terms specific to its service, which apply in addition to these Terms:

We reserve the right to modify, suspend, or discontinue any Service (or any feature thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of Services.

4.1 Permitted Use

You may use our Services solely for lawful purposes and in accordance with these Terms. You agree to use the Services in a manner consistent with all applicable local, state, national, and international laws and regulations.

4.2 Prohibited Activities

You expressly agree not to:

• Use the Services for any unlawful, fraudulent, or malicious purpose
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Upload, post, or transmit any content that is defamatory, obscene, hateful, discriminatory, or violates any third-party rights
• Attempt to gain unauthorised access to any part of the Services, other accounts, or related systems or networks
• Use automated tools (bots, scrapers, crawlers) to access or collect data from our platforms without written permission
• Interfere with or disrupt the integrity or performance of the Services or servers
• Introduce any viruses, malware, or other harmful code
• Reverse engineer, decompile, or disassemble any software forming part of the Services
• Use the Services to send unsolicited communications (spam)
• Engage in any activity that imposes an unreasonable load on our infrastructure
• Circumvent any security, access control, or usage restriction measures
• Facilitate or encourage any of the above activities

4.3 User Content

By submitting content (reviews, comments, images, or other materials) to our platforms, you grant Small Fare® a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, display, and distribute such content in connection with our Services. You represent that you own or have the necessary rights to grant this licence and that your content does not violate any third-party rights.

5.1 Our Intellectual Property

All content, features, and functionality of our Services — including but not limited to text, graphics, logos, icons, images, audio, video, software, and code — are the exclusive property of Small Fare Services Private Limited or its licensors and are protected by Indian and international copyright, trademark, patent, and other intellectual property laws.

The Small Fare® name and logo, and all brand names including Events Fare, Payblee, Filmskart, and Viral Wave, are registered or unregistered trademarks of Small Fare Services Private Limited. You may not use these marks without our prior written consent.

5.2 Licence to Use

Subject to your compliance with these Terms, Small Fare® grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal or internal business purposes. This licence does not include the right to:

• Sublicence, sell, resell, transfer, or assign any rights in the Services
• Modify, copy, create derivative works, or reproduce any portion of the Services
• Use the Services for commercial purposes without our prior written consent
• Remove any copyright, trademark, or other proprietary notices

5.3 Third-Party Content

Our Services may include content owned by third parties (e.g., film studios, event organisers, creators). Such content remains the property of the respective owners. We do not claim ownership of third-party content displayed on our platforms.

6.1 General Payment Terms

All payments processed through Small Fare® platforms are subject to the terms of our payment processing partners (PhonePe, Razorpay, Cashfree, EaseBuzz) and banking partners (Axis Bank, IndusInd Bank). By making a payment, you agree to their respective terms and conditions.

6.2 Pricing and Taxes

• All prices are displayed in Indian Rupees (INR) unless otherwise stated.
• Prices are inclusive of applicable GST unless explicitly stated otherwise.
• We reserve the right to change prices at any time without prior notice.
• You are responsible for any additional taxes, duties, or levies imposed by your jurisdiction.

6.3 Refunds and Cancellations

• Events Fare: Refunds are governed by the event organiser's refund policy displayed at the time of purchase. Small Fare® convenience fees are non-refundable.
• Payblee: Payment transactions once successfully processed cannot be reversed. Disputes must be raised within 7 days with supporting documentation.
• Filmskart: Returns accepted within 7 days for defective or incorrectly shipped items only. Items must be unused and in original packaging.
• Viral Wave: Campaign fees are subject to individual campaign agreements between brands and creators.

6.4 Failed Transactions

In the event of a payment failure, the amount will typically be refunded to your source account within 5–7 business days, subject to the policies of your bank and payment processor. Small Fare® is not liable for delays caused by banking systems or payment processors.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

• OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
• SMALL FARE® DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• SMALL FARE® DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE SERVICES.
• WE DO NOT GUARANTEE THAT SPECIFIC RESULTS WILL BE ACHIEVED FROM USE OF THE SERVICES, INCLUDING MARKETING OUTCOMES THROUGH VIRAL WAVE.
• EVENT LISTINGS ON EVENTS FARE ARE PROVIDED BY THIRD-PARTY ORGANISERS. SMALL FARE® DOES NOT WARRANT THE OCCURRENCE, QUALITY, OR SAFETY OF ANY EVENT.

Nothing in these Terms shall exclude or limit our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, IN NO EVENT SHALL SMALL FARE® OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES ARISING FROM UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA
• DAMAGES ARISING FROM THIRD-PARTY CONDUCT ON OUR PLATFORMS
• DISRUPTION OF SERVICE OR FORCE MAJEURE EVENTS

IN ANY CASE, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO SMALL FARE® IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR ₹5,000 (FIVE THOUSAND RUPEES), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless Small Fare® and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any rights of a third party, including intellectual property rights
• Your user-generated content or submissions
• Any misrepresentation made by you

Small Fare® reserves the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of such claim at your expense.

10.1 By Small Fare®

We reserve the right to suspend or terminate your account and access to any or all Services at any time, with or without cause and with or without notice, including but not limited to:

• Violation of these Terms or any supplementary policies
• Fraudulent, illegal, or abusive behaviour
• Non-payment of applicable fees
• Requests by law enforcement or government authorities
• Extended periods of inactivity

10.2 By You

You may terminate your account at any time by contacting us at info@smallfare.com. Termination does not entitle you to a refund of any amounts already paid. Outstanding obligations survive termination.

10.3 Effect of Termination

Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) shall remain in effect.

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The provisions of the Consumer Protection Act, 2019 shall apply where you are a consumer as defined thereunder.

11.2 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our Services, the parties shall first attempt to resolve the matter amicably through good-faith negotiation within 30 days of written notice.

If the dispute is not resolved through negotiation, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, or failing agreement, appointed by the Hyderabad High Court. The seat and venue of arbitration shall be Hyderabad, Telangana, India. The language of arbitration shall be English.

11.3 Jurisdiction

Subject to the arbitration clause above, you submit to the exclusive jurisdiction of the courts located in Hyderabad, Telangana for any matters not subject to arbitration.

12.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any supplementary terms applicable to specific Services, constitute the entire agreement between you and Small Fare® regarding the subject matter hereof and supersede all prior agreements.

12.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Small Fare®.

12.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.

12.5 Force Majeure

Small Fare® shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, government actions, internet outages, power failures, labour disputes, pandemics, or acts of war or terrorism.
